Laws § 554.94","heading":"Applicability of act to certain personal property; scope of trust.","body":"Sec. 4.\n\n(1) This act applies only to a nonvested interest in, or power of appointment over, personal property held in a trust that is either revocable on, or created after, May 28, 2008, and only to the extent that the trust is not a special appointee trust.\n\n(2) For purposes of this section, both of the following apply:\n\n(a) A trust that is created by the exercise of a power of appointment is created when the power has been irrevocably exercised or when a revocable exercise becomes irrevocable.\n\n(b) A trust is a \"special appointee trust\" to the extent it includes assets that were held in a trust that was irrevocable on September 25, 1985, and both of the following apply to the assets:\n\n( i ) The assets have continuously been held in trust since September 25, 1985.\n\n( ii ) The assets have not become subject to a general power of appointment since September 25, 1985.","path":["MI Code","Chapter 554","Act Act-148-of-2008"],"source_url":"https://www.legislature.mi.gov/Laws/MCL?objectName=mcl-554-94","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:31Z","sha256":"c256598226831d2a1082444dca9e9c817c82c77e4bfc1b83a65389172b50d59e","source_id":"us-mi","stale":false,"prev":"us-mi/mich.-comp.-laws-554.93","next":"us-mi/mich.-comp.-laws-554.1011"},"notice":"GroundRules: Original legal text.
