Laws § 559.305","heading":"Homeowners' association agreements; invalid and unenforceable provisions; local unit of government; permissible requirements.","body":"Sec. 5.\n\n(1) Any of the following in a homeowners' association agreement is invalid and unenforceable as contrary to public policy:\n\n(a) A provision that prohibits, or requires the approval of a homeowners' association for, a member to replace, maintain, install, or operate an energy-saving improvement or modification.\n\n(b) A provision that compels, or requires association approval for, a member to make auxiliary changes needed for the installation of an energy-saving improvement or modification.\n\n(2) A local unit of government shall not require a member to obtain the approval of a homeowners' association to do any of the following:\n\n(a) Replace, maintain, install, or operate an energy-saving improvement or modification.\n\n(b) Make auxiliary changes needed for the installation of an energy-saving improvement or modification.\n\n(3) Subject to subsection (2), this act does not prohibit a local unit of government from imposing requirements that may prohibit or limit the replacement, maintenance, installation, or operation of an energy-saving improvement or modification or making of auxiliary changes needed for the installation of an energy-saving improvement or modification by a member.","path":["MI Code","Chapter 559","Act Act-68-of-2024"],"source_url":"https://www.legislature.mi.gov/Laws/MCL?objectName=mcl-559-305","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:31Z","sha256":"3febc9822b4c3205a8779bcbda92050874a3558cd93055ba2902db91479e86e4","source_id":"us-mi","stale":false,"prev":"us-mi/mich.-comp.-laws-559.303","next":"us-mi/mich.-comp.-laws-559.307"},"notice":"GroundRules: Original legal text.
