Laws § 560.194","heading":"Flood plains; prohibit occupancy; alterations.","body":"Sec. 194.\n\nIf any part of a proposed subdivision lies within the floodplain of a river, stream, creek or lake, approval of the final plat shall be conditioned on the following:\n\nNo buildings for residential purposes and occupancy shall be located on any portion of a lot lying within a floodplain, unless approved in accordance with the rules of the water resources commission of the department of conservation.\n\nRestrictive deed covenants shall be filed and recorded with the final plat that the floodplain area will be left essentially in its natural state.\n\nThe natural floodplain may be altered if its original discharge capacity is preserved and the stream flow is not revised so as to affect the riparian rights of other owners.","path":["MI Code","Chapter 560","Act Act-288-of-1967"],"source_url":"https://www.legislature.mi.gov/Laws/MCL?objectName=mcl-560-194","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:31Z","sha256":"cc594e8a6d1ed2db1d95082bfea6baa09a75c55cb80042c524bc0246d797f924","source_id":"us-mi","stale":false,"prev":"us-mi/mich.-comp.-laws-560.192a","next":"us-mi/mich.-comp.-laws-560.196"},"notice":"GroundRules: Original legal text.
