Laws § 600.6128","heading":"Trying title to debt or property; third party claimant; jury.","body":"Sec. 6128.\n\nWhere it appears to the court that:\n\nThe judgment debtor may have an interest in or title to any real property, and such interest or title is disclaimed by the judgment debtor or disputed by another person;\n\nThe judgment debtor may own or have a right of possession to any personal property, and such ownership or right of possession is substantially disputed by another person; or\n\nA third party is indebted to the judgment debtor, and the obligation of the third party to pay the judgment debtor is disputed; the court may, if the person or persons claiming adversely is a party to the proceeding, adjudicate the respective interests of the parties in such debt or real or personal property, and may determine such property to be wholly or in part the property of the judgment debtor, or that the debt is owed the judgment debtor.\n\nIf the person claiming adversely to the judgment debtor is not a party to the proceeding, the court shall by show cause order or otherwise cause such person to be brought in and made a party thereto, and shall set such proceeding for early hearing.\n\nAny person so made a party, or any party to the original proceeding, may have such issue determined by a jury upon demand therefor and payment of a jury fee as in other civil actions if such person would be entitled to a jury trial if the matter was adjudicated in a separate action.","path":["MI Code","Chapter 600","Act Act-236-of-1961"],"source_url":"https://www.legislature.mi.gov/Laws/MCL?objectName=mcl-600-6128","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:31Z","sha256":"eb8c8c9dc505c82d18b2853d21484401d77953e2504ab01dd03174c464e6cb34","source_id":"us-mi","stale":false,"prev":"us-mi/mich.-comp.-laws-600.6125","next":"us-mi/mich.-comp.-laws-600.6131"},"notice":"GroundRules: Original legal text.
