Laws § 600.745","heading":"“State” defined; agreement of parties as basis for jurisdiction; conditions.","body":"Sec. 745.\n\nAs used in this section, \"state\" means any foreign nation, and any state, district, commonwealth, territory, or insular possession of the United States.\n\nIf the parties agreed in writing that an action on a controversy may be brought in this state and the agreement provides the only basis for the exercise of jurisdiction, a court of this state shall entertain the action if all the following occur:\n\nThe court has power under the law of this state to entertain the action.\n\nThis state is a reasonably convenient place for the trial of the action.\n\nThe agreement as to the place of the action is not obtained by misrepresentation, duress, the abuse of economic power, or other unconscionable means.\n\nThe defendant is served with process as provided by court rules.\n\nIf the parties agreed in writing that an action on a controversy shall be brought only in another state and it is brought in a court of this state, the court shall dismiss or stay the action, as appropriate, unless any of the following occur:\n\nThe court is required by statute to entertain the action.\n\nThe plaintiff cannot secure effective relief in the other state for reasons other than delay in bringing the action.\n\nThe other state would be a substantially less convenient place for the trial of the action than this state.\n\nThe agreement as to the place of the action is obtained by misrepresentation, duress, the abuse of economic power, or other unconscionable means.\n\nIt would for some other reason be unfair or unreasonable to enforce the agreement.","path":["MI Code","Chapter 600","Act Act-236-of-1961"],"source_url":"https://www.legislature.mi.gov/Laws/MCL?objectName=mcl-600-745","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:31Z","sha256":"3272bcabfd7001d6cb21e56979066ead946f743bff8184a1fdb25af53f3097d7","source_id":"us-mi","stale":false,"prev":"us-mi/mich.-comp.-laws-600.741","next":"us-mi/mich.-comp.-laws-600.751"},"notice":"GroundRules: Original legal text.
