Laws § 700.1043","heading":"Probate court; jurisdiction; venue.","body":"Sec. 3.\n\n(1) The probate court has exclusive jurisdiction over an action that addresses either of the following questions:\n\n(a) Whether a transfer is a qualified disposition.\n\n(b) The extent of the transferor's interest in, or the income from, a qualified disposition.\n\n(2) The probate court has concurrent jurisdiction over an action brought under section 5(2).\n\n(3) Venue for a proceeding under subsection (1) or (2) is as follows:\n\n(a) For a trust registered under section 7209 of the estates and protected individuals code, 1998 PA 386, MCL 700.7209, the place of registration.\n\n(b) For a trust that is not registered, in any place where the trust properly could be registered.\n\n(4) If a trust has no qualified trustee and has not been registered, and there is no place in this state where the trust properly could be registered, venue for a proceeding under subsection (1) or (2) is in the following order of priority, except to the extent otherwise provided by court rule:\n\n(a) In a county in this state in which the immediately preceding qualified trustee had its usual place of business or residence.\n\n(b) In a county in this state in which a trust beneficiary resides.\n\n(c) In a county in this state in which any trust property is located.\n\n(d) In any county in this state.","path":["MI Code","Chapter 700","Act Act-330-of-2016"],"source_url":"https://www.legislature.mi.gov/Laws/MCL?objectName=mcl-700-1043","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:31Z","sha256":"d339436b91f6114c0abaf9551f42891bf4b34a16937138200605be3a1ae329ae","source_id":"us-mi","stale":false,"prev":"us-mi/mich.-comp.-laws-700.1042","next":"us-mi/mich.-comp.-laws-700.1044"},"notice":"GroundRules: Original legal text.
