Laws § 700.2608","heading":"Ademption by satisfaction.","body":"Sec. 2608.\n\nProperty a testator gave in his or her lifetime to a person is treated as a satisfaction of a devise in whole or in part only if any of the following are true:\n\nThe will provides for a deduction of the gift.\n\nThe testator declared in a contemporaneous writing that the gift is in satisfaction of the devise or that its value is to be deducted from the value of the devise.\n\nThe devisee acknowledges in writing that the gift is in satisfaction of the devise or that its value is to be deducted from the value of the devise.\n\nFor purposes of partial satisfaction, property given during the testator's lifetime is valued as of the time the devisee came into possession or enjoyment of the property or at the testator's death, whichever occurs first.\n\nIf the devisee fails to survive the testator, the gift is treated as a full or partial satisfaction of the devise, as appropriate, in applying sections 2603 and 2604, unless the testator's contemporaneous writing provides otherwise.","path":["MI Code","Chapter 700","Act Act-386-of-1998"],"source_url":"https://www.legislature.mi.gov/Laws/MCL?objectName=mcl-700-2608","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:31Z","sha256":"d6e46374013c08a6c75ede26a3168017bb024451c34418e473c0769f50c7ddc6","source_id":"us-mi","stale":false,"prev":"us-mi/mich.-comp.-laws-700.2607","next":"us-mi/mich.-comp.-laws-700.2701"},"notice":"GroundRules: Original legal text.
