Laws § 722.1802","heading":"Requirements for consent to assisted reproduction.","body":"Sec. 202.\n\n(1) The consent described in section 201 must be either of the following:\n\n(a) In a record signed before, on, or after the birth of the child by the individual who gave birth to the child and by an individual who intends to be a parent of the child. An acknowledgment of parentage under the acknowledgment of parentage act, 1996 PA 305, MCL 722.1001 to 722.1013, is a record within the meaning of this subdivision.\n\n(b) In an agreement entered into before conception that the individual who gave birth to the child and the individual who intends to be a parent of the child intended they both would be parents of the child.\n\n(2) Failure to consent as required by subsection (1) does not preclude a court from finding consent to parent if the individual for the first 2 years of the child's life, including any period of temporary absence, resided in the same household with the child and openly held out the child as the individual's child.","path":["MI Code","Chapter 722","Act Act-24-of-2024"],"source_url":"https://www.legislature.mi.gov/Laws/MCL?objectName=mcl-722-1802","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:31Z","sha256":"9316383a1fe5b324ec20050512fe90ffce4ab03773af72d8773a0d1412645af6","source_id":"us-mi","stale":false,"prev":"us-mi/mich.-comp.-laws-722.1801","next":"us-mi/mich.-comp.-laws-722.1803"},"notice":"GroundRules: Original legal text.
