Laws § 752.3","heading":"Maintaining membership, supplying information to, or maintaining files supplied by interstate law enforcement intelligence organization; conditions; exceptions; effective date of section.","body":"Sec. 3.\n\nExcept as provided in section 2, a law enforcement agency shall not maintain membership, supply information to, or maintain files supplied by an interstate law enforcement intelligence organization unless all of the following conditions are met by the interstate law enforcement intelligence organization:\n\nThe organization is governed by a citizen oversight body which has the authority to periodically review the files maintained by the organization.\n\nThe files maintained by an organization are relevant to a criminal investigation or pertinent to and within the scope of an authorized law enforcement activity.\n\nThe organization does not maintain a record describing how an individual exercises rights guaranteed by the first amendment of the constitution of the United States.\n\nThe organization has established guidelines which provide for the review of files at regular intervals to insure the accuracy and legality of the file information.\n\nThe organization has established guidelines which provide for the destruction of outdated or inaccurate information.\n\nThe organization permits its files located in a state with a freedom of information act to be accessible to the public in accordance with that act.\n\nThis section shall take effect July 1, 1983.","path":["MI Code","Chapter 752","Act Act-201-of-1980"],"source_url":"https://www.legislature.mi.gov/Laws/MCL?objectName=mcl-752-3","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:31Z","sha256":"e405eeb0a1f9fbaa29d6bbad9163a5759509939e270c9128b2f607ad060ad73d","source_id":"us-mi","stale":false,"prev":"us-mi/mich.-comp.-laws-752.2","next":"us-mi/mich.-comp.-laws-752.4"},"notice":"GroundRules: Original legal text.
