Laws § 766.9","heading":"Closure of preliminary examination.","body":"Sec. 9.\n\nUpon the motion of any party, the examining magistrate may close to members of the general public the preliminary examination of a person charged with criminal sexual conduct in any degree, assault with intent to commit criminal sexual conduct, sodomy, gross indecency, or any other offense involving sexual misconduct if all of the following conditions are met:\n\nThe magistrate determines that the need for protection of a victim, a witness, or the defendant outweighs the public's right of access to the examination.\n\nThe denial of access to the examination is narrowly tailored to accommodate the interest being protected.\n\nThe magistrate states on the record the specific reasons for his or her decision to close the examination to members of the general public.\n\nIn determining whether closure of the preliminary examination is necessary to protect a victim or witness, the magistrate shall consider all of the following:\n\nThe psychological condition of the victim or witness.\n\nThe nature of the offense charged against the defendant.\n\nThe desire of the victim or witness to have the examination closed to the public.\n\nThe magistrate may close a preliminary examination to protect the right of a party to a fair trial only if both of the following apply:\n\nThere is a substantial probability that the party's right to a fair trial will be prejudiced by publicity that closure would prevent.\n\nReasonable alternatives to closure cannot adequately protect the party's right to a fair trial.","path":["MI Code","Chapter 760","Act Act-175-of-1927"],"source_url":"https://www.legislature.mi.gov/Laws/MCL?objectName=mcl-766-9","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:31Z","sha256":"dff34f6c0f018895bc23cc9b175a20229f6453d76a5b882d7ea4a9c7ecfa7e3a","source_id":"us-mi","stale":false,"prev":"us-mi/mich.-comp.-laws-766.8","next":"us-mi/mich.-comp.-laws-767.1"},"notice":"GroundRules: Original legal text.
