Laws § 780.823","heading":"Additional notice to victim; means; contents of impact statement.","body":"Sec. 73.\n\nThe prosecuting attorney, upon and in accordance with the request of the victim, shall give to the victim notice of the following:\n\nThe defendant's conviction.\n\nThe offenses for which the defendant was convicted.\n\nIf a presentence investigation report is to be prepared, the victim's right to make a written or oral impact statement for use in the preparation of the presentence investigation report concerning the defendant.\n\nThe address and telephone number of the probation office which is to prepare the presentence investigation report.\n\nThat a presentence investigation report and any statement of the victim included in the report will be made available to the defendant unless exempted from disclosure by the court.\n\nThe victim's right to make an impact statement at sentencing.\n\nThe time and place of the sentencing proceeding.\n\nThe notice given by the prosecuting attorney to the victim must be given by any means reasonably calculated to give prompt actual notice.\n\nA notice given under subsection (1) shall inform the victim that his or her impact statement may include but shall not be limited to the following:\n\nAn explanation of the nature and extent of any physical, psychological, or emotional harm or trauma suffered by the victim.\n\nAn explanation of the extent of any economic loss or property damage suffered by the victim.\n\nAn opinion of the need for and extent of restitution and whether the victim has applied for or received compensation for loss or damage.\n\nThe victim's recommendation for an appropriate sentence.","path":["MI Code","Chapter 780","Act Act-87-of-1985"],"source_url":"https://www.legislature.mi.gov/Laws/MCL?objectName=mcl-780-823","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:31Z","sha256":"b67de19866a17bc27da9e2549c06449d1fabba958aa7d3a851886a6dcf8180a0","source_id":"us-mi","stale":false,"prev":"us-mi/mich.-comp.-laws-780.822","next":"us-mi/mich.-comp.-laws-780.824"},"notice":"GroundRules: Original legal text.
