Payment rates.\nPayment rates paid to any nursing facility receiving medical assistance payments must be those rates established pursuant to this chapter and rules adopted under it.\nSubd. 1a. Payment rates for nursing care provided to a patient in a swing bed.\nPayment rates paid to any hospital for nursing care provided to a patient in a swing bed must be those rates established pursuant section 256B.0625, subdivision 2b.\n[See Note.]\nSubd. 2. Authority of commissioner.\nThe commissioner shall establish, by rule, procedures for determining rates for care of residents of nursing facilities which qualify as vendors of medical assistance, and for implementing the provisions of this chapter and section 256B.50. The procedures shall specify the costs that are allowable for establishing payment rates through medical assistance.\nSubd. 3. Compliance with federal requirements.\nIf any provision of this chapter and section 256B.50 is determined by the United States government to be in conflict with existing or future requirements of the United States government with respect to federal participation in medical assistance, the federal requirements shall prevail.","path":["PUBLIC WELFARE AND RELATED ACTIVITIES","CHAPTER 256R.
