Stat. § 198.099","heading":"Petition for appointment of receiver — when.","body":"The attorney general, either on his own initiative or upon the request of the department or of any other state governmental agency having an interest in the matter, a resident or residents or the guardian of a resident of a facility or the owner or operator of a facility may petition for appointment of a receiver for a facility when any of the following conditions exist:\n(1) The operator is operating without a license;\n(2) The department has revoked the license of an operator or refused to grant an application for a license to the operator;\n(3) The department has initiated revocation procedures and has determined that the lives, health, safety, or welfare of the residents cannot be adequately assured pending a full hearing on license revocation;\n(4) The facility is closing or intends to close and adequate arrangements for relocation of residents have not been made at least thirty days prior to closure;\n(5) An emergency exists in the facility;\n(6) The operator is insolvent; or\n(7) An owner of the land or structure is insolvent and such insolvency substantially affects the operation of the facility.","path":["Title XII - PUBLIC HEALTH AND WELFARE","Chapter 198 - Nursing Homes and Facilities"],"source_url":"https://revisor.mo.gov/main/OneSection.aspx?section=198.099","current_through":"2026 legislative session (floor)","vintage":"","retrieved_at":"2026-09-03T22:23:26Z","sha256":"69bb5177347769da2b7e5dd81504bf85c3c8c83344c5483605af1fb6f708ef97","source_id":"us-mo","stale":false,"prev":"us-mo/mo.-rev.-stat.-198.097","next":"us-mo/mo.-rev.-stat.-198.103"},"notice":"GroundRules: Original legal text.
