The provisions of sections 198.610 to 198.632 shall be known and may be cited as the \"Authorized Electronic Monitoring in Long-Term Care Facilities Act\".\n2. For purposes of sections 198.610 to 198.632, the following terms shall mean:\n(1) \"Authorized electronic monitoring\" , the placement and use of an electronic monitoring device by a resident in his or her room in accordance with the provisions of sections 198.610 to 198.632;\n(2) \"Department\" , the department of health and senior services;\n(3) \"Electronic monitoring device\" , a surveillance instrument capable of recording or transmitting audio or video footage of any activity occurring in a resident's room;\n(4) \"Facility\" or \"long-term care facility\" , any residential care facility, assisted living facility, intermediate care facility, or skilled nursing facility, as such terms are defined under section 198.006;\n(5) \"Guardian\" , the same meaning as defined under section 475.010;\n(6) \"Legal representative\" , a person authorized under a durable power of attorney that complies with sections 404.700 to 404.737 to act on behalf of a resident of a facility;\n(7) \"Resident\" , a person residing in a facility.","path":["Title XII - PUBLIC HEALTH AND WELFARE","Chapter 198 - Nursing Homes and Facilities"],"source_url":"https://revisor.mo.gov/main/OneSection.aspx?section=198.610","current_through":"2026 legislative session (floor)","vintage":"","retrieved_at":"2026-09-03T22:23:26Z","sha256":"970e7dc71f8b4811b4dbba40c8f06e5ca01a79280746b7e1b50cc05fabfa90ee","source_id":"us-mo","stale":false,"prev":"us-mo/mo.-rev.-stat.-198.545","next":"us-mo/mo.-rev.-stat.-198.612"},"notice":"GroundRules: Original legal text.
