Code Ann. § 11-71-11","body":"(1) Notwithstanding any other provision of this chapter, the immunities provided in this chapter shall not apply where the plaintiff shows, by clear and convincing evidence, that a defendant, or any employee or agent thereof, acted with actual malice or willful, intentional misconduct.\n\n(2) Nothing in this chapter:\n\n(a) Creates, recognizes or ratifies a claim or cause of action of any kind;\n\n(b) Eliminates a required element of any claim;\n\n(c) Affects workers' compensation law, including the exclusive application of such law; or\n\n(d) Amends, repeals, alters or affects any other immunity or limitation of liability.","path":["MS Code","Title 11"],"source_url":"https://legislature.ms.gov/","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:17Z","sha256":"b2e31092143db84fae35dc6e0efa7cd95dd9b50cd92ce62260d8608806666466","source_id":"us-ms","stale":false,"prev":"us-ms/miss.-code-ann.-11-71-1","next":"us-ms/miss.-code-ann.-11-71-13"},"notice":"GroundRules: Original legal text.
