Code Ann. § 25-34-17","body":"(1) A notarial officer may refuse to perform a notarial act if the officer knows or suspects the transaction is illegal, false or deceptive, or if the officer is not satisfied that:\n\n(a) The individual executing the record is competent;\n\n(b) The individual executing the record has the capacity to execute the record;\n\n(c) The individual's signature is knowingly and voluntarily made; or\n\n(d) The notarial act is in compliance with this chapter or with rules issued by the Secretary of State to implement this chapter.\n\n(2) A notarial officer may refuse to perform a notarial act unless refusal is prohibited by any law other than this chapter.\n\n(3) A notary may not be required to perform a notarial act outside the notary's regular workplace or business hours.","path":["MS Code","Title 25"],"source_url":"https://legislature.ms.gov/","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:17Z","sha256":"7cf3007d97d731bf60f68db021d24fa0929f439eded953aaf8e33225cb11f7b6","source_id":"us-ms","stale":false,"prev":"us-ms/miss.-code-ann.-25-34-15","next":"us-ms/miss.-code-ann.-25-34-19"},"notice":"GroundRules: Original legal text.
