{"data":{"id":"us-ms/miss.-code-ann.-25-43-4.107","jurisdiction":"us-ms","citation":"Miss. Code Ann. § 25-43-4.107","heading":"Miss. Code Ann. § 25-43-4.107","body":"(1) Notwithstanding any other law of this state, any agency authorized to assess administrative penalties or administrative fines upon a business may waive or reduce any administrative penalty or administrative fine for a violation of any statute, ordinance, or rules by a small business under the following conditions:\n\n(a) The small business corrects the violation within thirty (30) days or less after receipt of a notice of violation or citation;\n\n(b) The violation was the result of an excusable misunderstanding of an agency's interpretation of a rule; or\n\n(c) The agency determines that the small business is making a good-faith effort to comply with the statute, ordinance or rule.\n\n(2) Subsection (1) of this section shall not apply when:\n\n(a) A small business fails to exercise good faith in complying with the statute, ordinance or rule;\n\n(b) A violation involves criminal conduct;\n\n(c) A violation results in serious health, safety or environmental impact; or\n\n(d) The penalty or fine is assessed pursuant to a federal law or regulation and for which no waiver or reduction is authorized by the federal law or regulation.","path":["MS Code","Title 25"],"source_url":"https://legislature.ms.gov/","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:17Z","sha256":"ccf08664c8eae4d046a62ed9e7e5b859e9e782132a5fefa96f3d53e2a74c3080","source_id":"us-ms","stale":false,"prev":"us-ms/miss.-code-ann.-25-43-4.106","next":"us-ms/miss.-code-ann.-25-43-4.108"},"notice":"GroundRules: Original legal text.
