Code Ann. § 27-57-17","body":"(1) There shall not be included in the measure of the tax levied hereunder any lubricating oils:\n\n(a) Sold or delivered by a distributor to another distributor within this state.\n\n(b) Sold by a distributor to the United States government for use of the armed forces only and delivered in quantities of not less than fifty (50) gallons.\n\n(c) Exported to a destination beyond the borders of this state by any person, by ship, vessel, barge, railroad tank car, pipeline, or tank truck, if such tank truck is operated by a common or contract carrier.\n\n(d) Exported to destination beyond the borders of this state by a distributor.\n\n(e) Sold in quantities of fifty (50) gallons, or more, to be used by any railroad locomotive, boat, vessel, ship, towboat, or dredgeboat.\n\n(f) Brought into this state in the reservoir provided by the manufacturer of a vehicle as the container of oils used exclusively for lubricating said vehicle.\n\n(2) Evidence of exempt transactions provided in this section and the subsections thereof shall consist of copies of invoices, documents or any other evidence that may be required by the department. In order to claim exemptions provided under this article, the distributor of lubricating oil must file claims therefor within three (3) years from the date of sale or delivery; otherwise, claims for such exemptions shall be disallowed.","path":["MS Code","Title 27"],"source_url":"https://legislature.ms.gov/","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:17Z","sha256":"a7e0d7b81fb10446fa6389564f0dfb9d24d01741b71e9318b7ad2dbbc349acd8","source_id":"us-ms","stale":false,"prev":"us-ms/miss.-code-ann.-27-57-15","next":"us-ms/miss.-code-ann.-27-57-19"},"notice":"GroundRules: Original legal text.
