Code Ann. § 33-13-321","body":"(1) The trial counsel, the defense counsel, the accused, if not represented by counsel, and the court-martial shall have equal opportunity to obtain witnesses and other evidence. Each shall have the right of compulsory process for obtaining witnesses.\n\n(2) The military judge or summary court officer of a court-martial may:\n\n(a) Issue a warrant for the arrest of any accused person who having been served with a warrant and a copy of the charges, disobeys a written order by the convening authority to appear before the court;\n\n(b) Issue a subpoena duces tecum and other subpoenas;\n\n(c) Enforce by attachment the attendance of witnesses and the production of books and papers; and\n\n(d) Sentence for refusal to be sworn or to answer, as provided in actions before civil courts of the state.\n\n(3) Process issued in court-martial cases to compel witnesses to appear and testify and to compel the production of other evidence shall run to any part of the state and shall be executed by civil officers or peace officers as prescribed by the laws of the state.","path":["MS Code","Title 33"],"source_url":"https://legislature.ms.gov/","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-17","retrieved_at":"2026-09-17T20:49:39Z","sha256":"e8c6cba8329a1f7cc71ca69adf6c87071e3234f568f0b01cd199aba2a50bdd98","source_id":"us-ms","stale":false,"prev":"us-ms/miss.-code-ann.-33-13-319","next":"us-ms/miss.-code-ann.-33-13-323","notices":[{"id":"open-us-law","title":"Open US Law compilation","text":"Compilation CC BY 4.0, Open US Law (Vaquill AI).
