Code Ann. § 41-41-157","body":"(1) Civil and criminal penalties for violations of Sections 41-41-151 through 41-41-169 may be imposed under the following priority:\n\n(a) Injunctive relief;\n\n(b) Civil cause of action; and\n\n(c) Criminal action.\n\n(2) A cause of action for injunctive relief against a person who has performed or attempted to perform a dismemberment abortion in violation of Section 41-41-155 may be maintained as a priority action by:\n\n(a) A woman upon whom such a dismemberment abortion was performed or attempted to be performed;\n\n(b) A person who is the spouse, parent or guardian of, or a current or former licensed health care provider of, a woman upon whom such a dismemberment abortion was performed or attempted to be performed; or\n\n(c) A prosecuting attorney with appropriate jurisdiction.\n\n(3) The injunction shall prevent the defendant from performing or attempting to perform further dismemberment abortions in violation of Section 41-41-155 in this state.","path":["MS Code","Title 41"],"source_url":"https://legislature.ms.gov/","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:17Z","sha256":"43dfe64ae9d37bcc55b9104f4ef6741f906b846f3e425ab4ae7947d9eb62ace5","source_id":"us-ms","stale":false,"prev":"us-ms/miss.-code-ann.-41-41-155","next":"us-ms/miss.-code-ann.-41-41-159"},"notice":"GroundRules: Original legal text.
