Code Ann. § 41-41-161","body":"(1) If judgment is rendered in favor of the plaintiff in an action described in Section 41-41-157 or 41-41-159 , the court shall also render judgment for a reasonable attorney's fee in favor of the plaintiff against the defendant.\n\n(2) If judgment is rendered in favor of the defendant in an action described in Section 41-41-157 or 41-41-159 and the court finds that the plaintiff's suit was frivolous and brought in bad faith, the court shall render judgment for a reasonable attorney's fee in favor of the defendant against the plaintiff.\n\n(3) No attorney's fee may be assessed against the woman upon whom a dismemberment abortion was performed or attempted to be performed except in accordance with subsection (2) of this section.","path":["MS Code","Title 41"],"source_url":"https://legislature.ms.gov/","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:17Z","sha256":"719d10c40b9a3bd774df6f7141476f97dbead3b043678c3f6c2446d231fd7036","source_id":"us-ms","stale":false,"prev":"us-ms/miss.-code-ann.-41-41-16","next":"us-ms/miss.-code-ann.-41-41-163"},"notice":"GroundRules: Original legal text.
