Code Ann. § 47-5-909","body":"(1) It is the policy of the Legislature that all inmates be removed from county jails as early as practicable. Sections 47-5-901 through 47-5-907 are temporary measures to help alleviate the immediate operating capacity limitations at correctional facilities and are not permanent measures to be included in the long-term operating capacity of the correctional system.\n\n(2) Notwithstanding any other provision of law, to expedite the removal of inmates from county jails as early as practicable, absent a contract negotiated between the Department of Corrections and the county jail, the Department of Corrections shall pay county jails for housing state offenders out of any available funds as follows:\n\n(a) Twenty-five Dollars ($25.00) per day per offender for days one (1) through thirty (30);\n\n(b) Thirty-two Dollars and Seventy-one Cents ($32.71) per day per offender for days thirty-one (31) or greater when:\n\n(i) An offender remains in the county jail after the Department of Corrections receives a certified copy of the sentencing order or five (5) days after the sentencing order is sent, in writing, by such county to the Department of Corrections, whichever is earlier; or\n\n(ii) An offender remains in the county jail after being revoked from parole or probation or is sentenced to a technical violation center.\n\n(3) The Department of Corrections is additionally responsible for all medical costs related to offenders housed at county jails under subsection (2) of this section.","path":["MS Code","Title 47"],"source_url":"https://legislature.ms.gov/","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:17Z","sha256":"5399cc9e4d8aa3dc140f6fa097dd7e9dbc460f9b6fcf09bdbacce63f6a9bf4d8","source_id":"us-ms","stale":false,"prev":"us-ms/miss.-code-ann.-47-5-907","next":"us-ms/miss.-code-ann.-47-5-91"},"notice":"GroundRules: Original legal text.
