Code Ann. § 49-19-35","body":"As used in this section:\n\n(a) “ Biomass ” means bioenergy feedstocks from forest products manufacturing, including, without limitation:\n\n(i) Forest products manufacturing residuals, including, without limitation:\n\n1. Pulping liquors;\n\n2. Pulping byproducts;\n\n3. Woody manufacturing residuals;\n\n4. Paper recycling residuals;\n\n5. Wastewater and processed water treatment plant residuals; and\n\n6. Anaerobic digester biogas;\n\n(ii) Harvest residues, including, without limitation, trees or portions of harvested trees;\n\n(iii) Downed wood from extreme weather events or natural disasters;\n\n(iv) Nonhazardous landscape or right-of-way trimmings and municipal trimmings;\n\n(v) Plant material removed for purposes of invasive or noxious plant species control;\n\n(vi) Biowaste, including, without limitation, landfill gas;\n\n(vii) Forest biomass derived from residues created as a byproduct of timber harvesting;\n\n(viii) Forest management activities conducted for timber stand improvement or to increase yield, ecological restoration or to maintain or enhance forest health;\n\n(ix) Biomass materials described by the United States Environmental Protection Agency as fuels under 40 CFR Statute 241.1 et seq., as it existed on January 1, 2023; and\n\n(x) Other used wood products, including, without limitation, crates and pallets.\n\n(b) “ Bioenergy with carbon capture and storage ” means the process of capturing and permanently storing carbon dioxide from biomass energy generation.","path":["MS Code","Title 49"],"source_url":"https://legislature.ms.gov/","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:17Z","sha256":"af4266bc3177cc64127b11e33a805ea375c40157f7cf78690109214be5a3965f","source_id":"us-ms","stale":false,"prev":"us-ms/miss.-code-ann.-49-19-33","next":"us-ms/miss.-code-ann.-49-19-351"},"notice":"GroundRules: Original legal text.
