Code Ann. § 51-3-29","body":"The following are hereby declared to constitute unpermitted waters:\n\n(a) All water which has not been permitted prior to April 1, 1985;\n\n(b) All surface water for which a permit had been issued prior to April 1, 1985, but for which no notice of claim has been filed by the expiration of three (3) years from April 1, 1985;\n\n(c) All groundwater which was not subjected to use for a beneficial purpose on April 1, 1985;\n\n(d) All water which having been used flows or seeps back or otherwise returns to a natural watercourse or waterbody, whether on the surface or underground.","path":["MS Code","Title 51"],"source_url":"https://legislature.ms.gov/","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:17Z","sha256":"702707638181bd2794c14443a28fc8e08b85b00d7fb24bd3a0a59a5a5233d8dd","source_id":"us-ms","stale":false,"prev":"us-ms/miss.-code-ann.-51-3-25","next":"us-ms/miss.-code-ann.-51-3-3"},"notice":"GroundRules: Original legal text.
