{"data":{"id":"us-mt/72-38-815","jurisdiction":"us-mt","citation":"72-38-815","heading":"General powers of trustee.","body":"(1) A trustee, without authorization by the court, may exercise:\n(a) powers conferred by the terms of the trust; and\n(b) except as limited by the terms of the trust:\n(i) all powers over the trust property that an unmarried competent owner has over individually owned property;\n(ii) any other powers appropriate to achieve the proper investment, management, and distribution of the trust property; and\n(iii) any other powers conferred by this chapter.\n(2) The exercise of a power is subject to the fiduciary duties prescribed by 72-38-801 through 72-38-817.","path":["TITLE 72.
