Stat. § 130A-412.11","heading":"Who may make an anatomical gift of decedent's body or body part.","body":"(a)\tSubject to subsections (b) and (c) of this section, and unless barred by G.S. 130A-412.9 or G.S. 130A-412.10, an anatomical gift of a decedent's body or body part for purpose of transplantation, therapy, research, or education may be made by any member of the following classes of persons who is reasonably available, in the order of priority listed:\n(1)\tAn agent of the decedent at the time of death who could have made an anatomical gift under G.S. 130A-412.6(2) immediately before the decedent's death;\n(2)\tThe spouse of the decedent;\n(3)\tAdult children of the decedent;\n(4)\tParents of the decedent;\n(5)\tAdult siblings of the decedent;\n(6)\tAdult grandchildren of the decedent;\n(7)\tGrandparents of the decedent;\n(8)\tAn adult who exhibited special care and concern for the decedent;\n(9)\tThe persons who were acting as the guardians of the person of the decedent at the time of death; and\n(10)\tAny other person having the authority to dispose of the decedent's body.\n(b)\tIf there is more than one member of a class listed in subdivision (a)(1), (3), (4), (5), (6), (7), or (9) of this section entitled to make an anatomical gift, an anatomical gift may be made by a member of the class unless that member or a person to which the gift may pass under G.S. 130A-412.13 knows of an objection by another member of the class. If an objection is known, the gift may be made only by a majority of the members of the class who are reasonably available.\n(c)\tA person may not make an anatomical gift if, at the time of the decedent's death, a person in a prior class under subsection (a) of this section is reasonably available to make or to object to the making of an anatomical gift.
