Stat. § 143B-1209.16","heading":"Criminal record checks of applicants and current employees who access federal tax information.","body":"(a)\tThe State Bureau of Investigation may, upon request, provide to the Division of Social Services or Division of Health Benefits within the Department of Health and Human Services or a county agency the criminal history from the State and National Repositories of Criminal Histories of the following individuals if the individual is permitted, or will be permitted, to access federal tax information:\n(1)\tAn applicant for employment.\n(2)\tA current employee.\n(3)\tA contractual employee or applicant.\n(4)\tAn employee of a contractor.\n(b)\tAlong with the request, the requesting agency shall provide the following to the Bureau:\n(1)\tThe fingerprints of the person who is the subject of the record check.\n(2)\tA form signed by the person who is the subject of the record check consenting to:\na.\tThe criminal record check.\nb.\tThe use of fingerprints.\nc.\tAny other identifying information required by the State and National Repositories.\nd.\tAny additional information required by the Department of Public Safety.\n(c)\tThe fingerprints shall be used for a search of the State's criminal history record file, and the Bureau shall forward a set of fingerprints to the Federal Bureau of Investigation for a national criminal history record check.\n(d)\tThe requesting agency shall keep all information obtained pursuant to this section confidential.\n(e)\tThe Bureau may charge a fee to offset the cost incurred by it to conduct a criminal record check under this section.
