Stat. § 143B-1209.36","heading":"Criminal record checks of applicants and of current employees who are involved in the manufacture or production of drivers licenses and identification cards.","body":"(a)\tThe State Bureau of Investigation may, upon request, provide to the Department of Transportation, Division of Motor Vehicles, the criminal history from the State and National Repositories of Criminal Histories of the following individuals if the individual (i) is or will be involved in the manufacture or production of drivers licenses and identification cards, or (ii) has or will have the ability to affect the identity information that appears on drivers licenses or identification cards:\n(1)\tAn applicant for employment.\n(2)\tA current employee.\n(3)\tA contractual employee or applicant.\n(4)\tAn employee of a contractor.\n(b)\tAlong with the request, the Division of Motor Vehicles shall provide the following to the Bureau:\n(1)\tThe fingerprints of the person who is the subject of the record check.\n(2)\tA form signed by the person who is the subject of the record check consenting to:\na.\tThe criminal record check.\nb.\tThe use of fingerprints.\nc.\tAny other identifying information required by the State and National Repositories.\nd.\tAny additional information required by the Department of Public Safety.\n(c)\tThe fingerprints shall be used for a search of the State's criminal history record file, and the Bureau shall forward a set of fingerprints to the Federal Bureau of Investigation for a national criminal history record check.\n(d)\tThe Division of Motor Vehicles shall keep all information obtained pursuant to this section confidential.\n(e)\tThe Bureau may charge a fee to offset the cost incurred by it to conduct a criminal record check under this section.
