Stat. § 52C-4-401","heading":"Establishment of support order.","body":"(a)\tIf a support order entitled to recognition under this Chapter has not been issued, a responding tribunal of this State with personal jurisdiction over the parties may issue a support order if:\n(1)\tThe individual seeking the order resides outside this State; or\n(2)\tThe support enforcement agency seeking the order is located outside this State.\n(b)\tThe tribunal may issue a temporary child support order if the tribunal determines that such an order is appropriate and the individual ordered to pay is any of the following:\n(1)\tA presumed father of the child.\n(2)\tPetitioning to have his paternity adjudicated.\n(3)\tIdentified as the father of the child through genetic testing.\n(4)\tAn alleged father who has declined to submit to genetic testing.\n(5)\tShown by clear and convincing evidence to be the father of the child.\n(6)\tAn acknowledged father as provided by Chapter 110 of the General Statutes.\n(7)\tThe mother of the child.\n(8)\tAn individual who has been ordered to pay child support in a previous proceeding and the order has not been reversed or vacated.\n(c)\tUpon finding, after notice and opportunity to be heard, that an obligor owes a duty of support, the tribunal shall issue a support order directed to the obligor and may issue other orders pursuant to G.S. 52C-3-305.
