Code § 12-60.1-02","heading":"Grounds to file petition to seal criminal record","body":"1.An individual may file a petition to seal a criminal record if:\na.The individual pled guilty to or was found guilty of a misdemeanor offense and the individual has not been convicted of a new crime for at least three years before filing the petition;\nb.The individual pled guilty to or was found guilty of a felony offense and the individual has not been convicted of a new crime for at least five years before filing the petition; or\nc.The individual was granted an unconditional pardon of the criminal conviction by the governor.\n2.Except as provided under section 12-60.1-05, this chapter does not apply to:\na.A felony offense involving violence or intimidation during the period in which the offender is ineligible to possess a firearm under subdivision a of subsection 1 of section 62.1-02-01; or\nb.An offense for which an offender has been ordered to register under section 12.1-32-15.","path":["Title 12 Corrections, Parole, And Probation","Chapter 12-60.1 Sealing Criminal Records"],"source_url":"https://ndlegis.gov/cencode/t12c60-1.pdf","current_through":"2026-07-31T11:12:02","vintage":"","retrieved_at":"2026-09-02T21:04:14Z","sha256":"7fa9cda96d4afa73c97c70d618719260d764addcfb704adcb2670aa0f9238a6a","source_id":"us-nd","stale":true,"prev":"us-nd/n.d.-cent.-code-12-60.1-01","next":"us-nd/n.d.-cent.-code-12-60.1-03"},"notice":"GroundRules: Original legal text.
