Code § 12.1-27.1-03.4","heading":"Restrictions on adult-oriented performances - Penalty","body":"1.As used in this section:\na.\"Adult-oriented performance\" means a performance that, regardless of whether or not performed for consideration, is intended to appeal to a prurient interest and features:\n(1)The purposeful exposure, whether complete or partial, of:\n(a)A human genital, the pubic region, the human buttocks, or a female breast, if the breast is exposed below a point immediately above the top of the areola; or\n(b)Prosthetic genitalia, breasts, or buttocks; or\n(2)Sexual conduct.\nb.\"Public property\" means real property in which a state agency or a political subdivision has an ownership interest.\n2.A person is guilty of a class A misdemeanor for a first offense and a class C felony for a second or subsequent offense if the person organizes an adult-oriented performance:\na.On public property; or\nb.At a business establishment frequented by minors, or where minors are or may be invited as a part of the general public.","path":["Title 12.1 Criminal Code","Chapter 12.1-27.1 Obscenity Control"],"source_url":"https://ndlegis.gov/cencode/t12-1c27-1.pdf","current_through":"2026-07-31T11:12:02","vintage":"","retrieved_at":"2026-09-02T21:04:14Z","sha256":"36aec14cf71bf82ddaf2783f0e746dd7afec34105d5fcfe872eb0473a24949f5","source_id":"us-nd","stale":true,"prev":"us-nd/n.d.-cent.-code-12.1-27.1-03.3","next":"us-nd/n.d.-cent.-code-12.1-27.1-03.5"},"notice":"GroundRules: Original legal text.
