Code § 12.1-32-12","heading":"Penalties, sentences, and parole for offenses unclassified and in other titles","body":"Where an offense is defined by a statute or by the constitution without specification of its classification pursuant to section 12.1-32-01, the offense is punishable as provided in the statute or constitutional provision defining it, or:\n1.If the offense is declared to be a felony, without further specification of punishment, it is punishable as if it were a class C felony.\n2.If the offense is declared to be a misdemeanor, without further specification of punishment, it is punishable as if it were a class A misdemeanor.
