Code § 12.1-35-01","heading":"Definitions","body":"In this chapter, unless the context or subject matter otherwise requires:\n1.\"Child\" means an individual under the age of eighteen years.\n2.\"Child development specialist\" means an individual who demonstrates educational and work experience exhibiting an understanding of child development and behavior.\n3.\"Court\" means a forum established by law for the adjudication of juvenile petitions, criminal complaints, informations, or indictments.\n4.\"Family member\" means a spouse, child, sibling, parent, legal guardian, or custodian of a victim.\n5.\"Prosecuting attorney\" includes city attorney, state's attorney, attorney general, or their assistants.\n6.\"Sex offense\" includes all sex offenses defined as such in chapter 12.1-20.\n7.\"Victim\" means a living child who has suffered direct or threatened physical, financial, or emotional harm as a result of the commission or attempted commission of a crime.\n8.\"Witness\" means any living child who has been or is expected to be summoned to testify in a criminal case whether or not any action or proceeding has been commenced.","path":["Title 12.1 Criminal Code","Chapter 12.1-35 Child Victim And Witness Fair Treatment Standards"],"source_url":"https://ndlegis.gov/cencode/t12-1c35.pdf","current_through":"2026-07-31T11:12:02","vintage":"","retrieved_at":"2026-09-02T21:04:14Z","sha256":"3eb1cdca4f2a4eb8dba0c156aed84f90b291e2bae6e992ad5ed8cf582ed86401","source_id":"us-nd","stale":false,"prev":"us-nd/n.d.-cent.-code-12.1-34-08","next":"us-nd/n.d.-cent.-code-12.1-35-02"},"notice":"GroundRules: Original legal text.
