Code § 14-07.7-09","heading":"Sexual assault restraining order","body":"1.The court may grant a sexual assault restraining order if:\na.The petitioner files a petition under section 14-07.7-02;\nb.The sheriff serves the respondent with a copy of the temporary sexual assault restraining order issued under section 14-07.7-08 and with notice of the time and place of the hearing;\nc.The court sets a hearing for no later than fourteen days after issuance of the temporary sexual assault restraining order or a later date if good cause is shown; and\nd.The court finds after the hearing there are reasonable grounds to believe the respondent committed sexual assault.\n2.The order must include provisions prohibiting the respondent from:\na.Harassing, stalking, or threatening the protected individual;\nb.Appearing at the residence, school, and place of employment of the protected individual; and\nc.Contacting the protected individual.\n3.The relief granted by the sexual assault restraining order may not exceed two years.","path":["Title 14 Domestic Relations And Persons","Chapter 14-07.7 Civil Protection Orders"],"source_url":"https://ndlegis.gov/cencode/t14c07-7.pdf","current_through":"2026-07-31T11:12:02","vintage":"","retrieved_at":"2026-09-02T21:04:14Z","sha256":"49697d0aaffb4a17a718849f179da576fedbc4fb61f6418d3adea80434a59046","source_id":"us-nd","stale":true,"prev":"us-nd/n.d.-cent.-code-14-07.7-08","next":"us-nd/n.d.-cent.-code-14-07.7-10"},"notice":"GroundRules: Original legal text.
