Code § 14-12.2-32","heading":"(401) Petition to establish support order","body":"1.If a support order entitled to recognition under this chapter has not been issued, a responding tribunal of this state with personal jurisdiction over the parties may issue a support order if:\na.The individual seeking the order resides outside this state; or\nb.The support enforcement agency seeking the order is located outside this state.\n2.The tribunal may issue a temporary child support order if the tribunal determines that such an order is appropriate and the individual ordered to pay is:\na.A presumed father of the child;\nb.Petitioning to have his paternity adjudicated;\nc.Identified as the father of the child through genetic testing;\nd.An alleged father who has declined to submit to genetic testing;\ne.Shown by clear and convincing evidence to be the father of the child;\nf.An acknowledged father as provided by chapter 14-20;\ng.The mother of the child; or\nh.An individual who has been ordered to pay child support in a previous proceeding and the order has not been reversed or vacated.\n3.Upon finding, after notice and opportunity to be heard, that an obligor owes a duty of support, the tribunal shall issue a support order directed to the obligor and may issue other orders under section 14-12.2-17.","path":["Title 14 Domestic Relations And Persons","Chapter 14-12.2 Uniform Interstate Family Support Act"],"source_url":"https://ndlegis.gov/cencode/t14c12-2.pdf","current_through":"2026-07-31T11:12:02","vintage":"","retrieved_at":"2026-09-02T21:04:14Z","sha256":"b243e4d9c77c32e1510a43b0f72cd83b8e78dffba52e66c112e1867c630a0d35","source_id":"us-nd","stale":true,"prev":"us-nd/n.d.-cent.-code-14-12.2-31","next":"us-nd/n.d.-cent.-code-14-12.2-32.1"},"notice":"GroundRules: Original legal text.
