Code § 14-12.2-47.4","heading":"(704) Initiation by department of health and human services of support proceeding under convention","body":"1.In a support proceeding under the convention, the department of health and human services of this state shall:\na.Transmit and receive applications; and\nb.Initiate or facilitate the institution of a proceeding regarding an application in a tribunal of this state.\n2.The following support proceedings are available to an obligee under the convention:\na.Recognition or recognition and enforcement of a foreign support order;\nb.Enforcement of a support order issued or recognized in this state;\nc.Establishment of a support order if there is no existing order, including, where necessary, determination of parentage of a child;\nd.Establishment of a support order if recognition of a foreign support order is refused under subdivision b, d, or i of subsection 2 of section 14-12.2-47.8;\ne.Modification of a support order of a tribunal of this state; and\nf.Modification of a support order of a tribunal of another state or foreign country.\n3.The following support proceedings are available under the convention to an obligor against whom there is an existing support order:\na.Recognition of an order suspending or limiting enforcement of an existing support order of a tribunal of this state;\nb.Modification of a support order of a tribunal of this state; and\nc.Modification of a support order of a tribunal of another state or foreign country.","path":["Title 14 Domestic Relations And Persons","Chapter 14-12.2 Uniform Interstate Family Support Act"],"source_url":"https://ndlegis.gov/cencode/t14c12-2.pdf","current_through":"2026-07-31T11:12:02","vintage":"","retrieved_at":"2026-09-02T21:04:14Z","sha256":"43a27a1f92210be3efcf9a78601d13c1db22cf2c08caee47c7f4f6decdb98cba","source_id":"us-nd","stale":true,"prev":"us-nd/n.d.-cent.-code-14-12.2-47.3","next":"us-nd/n.d.-cent.-code-14-12.2-47.5"},"notice":"GroundRules: Original legal text.
