Code § 14-14.1-13","heading":"(202) Exclusive, continuing jurisdiction","body":"1.Except as otherwise provided in section 14-14.1-15, a court of this state which has made a child custody determination consistent with section 14-14.1-12 or 14-14.1-14 has exclusive, continuing jurisdiction over the determination until:\na.A court of this state determines that neither the child, nor the child and one parent, nor the child and a person acting as a parent have a significant connection with this state and that substantial evidence is no longer available in this state concerning the child's care, protection, training, and personal relationships; or\nb.A court of this state or a court of another state determines that the child, the child's parents, and any person acting as a parent do not presently reside in this state.\n2.A court of this state which has made a child custody determination and does not have exclusive, continuing jurisdiction under this section may modify that determination only if it has jurisdiction to make an initial determination under section 14-14.1-12.","path":["Title 14 Domestic Relations And Persons","Chapter 14-14.1 Uniform Child Custody Jurisdiction And Enforcement Act"],"source_url":"https://ndlegis.gov/cencode/t14c14-1.pdf","current_through":"2026-07-31T11:12:02","vintage":"","retrieved_at":"2026-09-02T21:04:14Z","sha256":"b52039ec71e7bc5a25cc569665bd9294c0251dc9b4cc037c800388c805079352","source_id":"us-nd","stale":true,"prev":"us-nd/n.d.-cent.-code-14-14.1-12","next":"us-nd/n.d.-cent.-code-14-14.1-14"},"notice":"GroundRules: Original legal text.
