Code § 15-39.1-12","heading":"Early reduced retirement benefits","body":"A member who has acquired a vested right to a retirement annuity as set forth in section 15-39.1-11 and who has attained age fifty-five may retire prior to the normal retirement age as set forth in section 15-39.1-10 but the benefits to which the member is then entitled must be reduced according to the following schedule:\n1.All tier one grandfathered member benefits must be reduced by six percent per annum from the earlier of:\na.Age sixty-five; or\nb.The age at which the sum of the member's current years of service credit and years of age equals eighty-five.\n2.All tier one nongrandfathered member and tier two member benefits must be reduced by eight percent per annum from the earlier of:\na.Age sixty-five; or\nb.The later of:\n(1)Age sixty; or\n(2)The age at which the sum of the member's current years of service credit and years of age equals ninety.","path":["Title 15 Education","Chapter 15-39.1 Teachers' Fund For Retirement"],"source_url":"https://ndlegis.gov/cencode/t15c39-1.pdf","current_through":"2026-07-31T11:12:02","vintage":"","retrieved_at":"2026-09-02T21:04:14Z","sha256":"3b55a785a8bbfc509a573dce2257ad365cd5ef62229885f486c59adff87cc012","source_id":"us-nd","stale":true,"prev":"us-nd/n.d.-cent.-code-15-39.1-11","next":"us-nd/n.d.-cent.-code-15-39.1-12.1"},"notice":"GroundRules: Original legal text.
