Code § 23-16-16","heading":"Treatment of victims of sexual assault","body":"1.As used in this section:\na.\"Hospital\" means an entity required to obtain a license under section 23-16-01.\nb.\"Sexual assault\" has the same meaning as provided under section 12.1-20-07.\nc.\"Victim of sexual assault\" means an individual who:\n(1)States a sexual assault has been committed against the individual;\n(2)Is accompanied by another individual who states a sexual assault has been committed against the accompanied individual; or\n(3)Hospital personnel or a sexual assault nurse examiner have reason to believe is a victim of sexual assault.\n2.A hospital may not require a victim of sexual assault to submit to a forensic examination or to report the alleged sexual assault to law enforcement.\n3.A hospital without staff specially trained to perform a sexual assault forensic examination may coordinate with a community-based sexual assault nurse examiner nurse program or develop a sexual assault examiner nurse program to ensure all victims of sexual assault who want a sexual assault forensic examination or sexually transmitted infection treatment receive that examination or treatment.","path":["Title 23 Health And Safety","Chapter 23-16 Licensing Medical Hospitals"],"source_url":"https://ndlegis.gov/cencode/t23c16.pdf","current_through":"2026-07-31T11:12:02","vintage":"","retrieved_at":"2026-09-02T21:04:14Z","sha256":"6331776940512515f68eab81adf72a50af34a83433a351cd0cea610a03833b61","source_id":"us-nd","stale":true,"prev":"us-nd/n.d.-cent.-code-23-16-15","next":"us-nd/n.d.-cent.-code-23-16-17"},"notice":"GroundRules: Original legal text.
