Code § 23-27.2-03","heading":"Licensee evaluation - Notice","body":"1.The department shall identify and evaluate licensees that have:\na.A substantial likelihood to fail to comply with federal or state law or regulation;\nb.Indicated an intention to cease operation or change licensure level within sixty days; or\nc.Indicated a substantial likelihood of failure to respond to requests for service.\n2.Upon identification of a licensee that meets the criteria under subsection 1, the department may provide notice, in accordance with subsection 3, to the licensee by first-class mail. If provided, the notice must be sent to the:\na.Licensee;\nb.Service leader of record;\nc.Medical director of record; and\nd.Political subdivision that has jurisdiction over the licensee, if applicable.\n3.The notice must include:\na.The deadline for the licensee to respond in accordance with section 23-27.2-04;\nb.A detailed description of the circumstances of the licensee under subsection 1;\nc.The proposed corrective action that must be taken by the licensee; and\nd.Any resources available to the licensee to assist in taking corrective action.","path":["Title 23 Health And Safety","Chapter 23-27.2 Distressed Ambulance Service Program"],"source_url":"https://ndlegis.gov/cencode/t23c27-2.pdf","current_through":"2026-07-31T11:12:02","vintage":"","retrieved_at":"2026-09-02T21:04:14Z","sha256":"9a3b8f7d1aacf9fec889835839f9a5cd87346fb96475a227ba799fcdab6575c0","source_id":"us-nd","stale":true,"prev":"us-nd/n.d.-cent.-code-23-27.2-02","next":"us-nd/n.d.-cent.-code-23-27.2-04"},"notice":"GroundRules: Original legal text.
