Code § 23-35.1-02","heading":"Regional public health network - Joint powers agreement - Review by department - Criteria","body":"Before a group of public health units may be designated as a regional public health network and eligible for state funding, the department shall review the joint powers agreement the public health units entered and verify that:\n1.The regional public health network consists of:\na.At least two public health units serving a minimum population of fifteen thousand; or\nb.A minimum of three public health units.\n2.The joint powers agreement requires that the participating public health units:\na.Assess the health of the population;\nb.Identify workplan activities that meet the needs of the region;\nc.Comply with requirements adopted by rule;\nd.Meet department maintenance of effort funding requirements, which must be calculated based on each unit's dollar or mill levy public health unit contribution in the most recent calendar year; and\ne.Share core public health activities and measure outcomes in accordance with subsection 3.\n3.The joint powers agreement requires:\na.Evidence that network activities align with prevailing health status and community needs;\nb.Shared or expanded services, including the core public health activities of:\n(1)Preventing epidemics and spread of disease;\n(2)Protecting against environmental hazards;\n(3)Preventing injuries;\n(4)Promoting health behaviors;\n(5)Responding to disasters; and\n(6)Assuring the quality and accessibility of health services;\nc.Assurance of network performance measurement to demonstrate capacity, process, or health outcomes;\nd.Criteria for the future participation of public health units that were not parties to the original joint powers agreement;\ne.An application process by which public health units that were not parties to the original joint powers agreement may become participating districts; and\nf.A process by which public health units that were not parties to the original joint powers agreement may appeal a decision to deny an application to participate in the agreement to the department.\n4.The joint powers agreement provides for the structure of the governing body of the network.","path":["Title 23 Health And Safety","Chapter 23-35.1 Regional Public Health Networks"],"source_url":"https://ndlegis.gov/cencode/t23c35-1.pdf","current_through":"2026-07-31T11:12:02","vintage":"","retrieved_at":"2026-09-02T21:04:14Z","sha256":"f21be381d141104831dd7eae0b0e9b3431a3289938a73610c747c038ba33f173","source_id":"us-nd","stale":true,"prev":"us-nd/n.d.-cent.-code-23-35.1-01","next":"us-nd/n.d.-cent.-code-23-35.1-03"},"notice":"GroundRules: Original legal text.
