Code § 23.1-10-05","heading":"Revenue to the fund","body":"Revenue from the following sources must be deposited in the state treasury and credited to the fund:\n1.Moneys recovered by the department in an action or administrative proceeding based on violation of the state's environmental statutes, including actions for administrative expense recoveries, civil penalties, compensatory damages; and money paid pursuant to any agreement, stipulation, or settlement. This section does not limit the department's ability to agree to a supplemental environmental project as part of a settlement.\n2.Moneys donated to the department for the purposes of this chapter.\n3.Transfers from the abandoned oil and gas well plugging and site reclamation fund under subdivision f of subsection 2 of section 38-08-04.5.\n4.Moneys received from a federal agency for the purpose of this section.\n5.Any other moneys as may be deposited in the fund for use in carrying out the purposes of this chapter.","path":["Title 23.1 Environmental Quality","Chapter 23.1-10 Environmental Emergency Costs"],"source_url":"https://ndlegis.gov/cencode/t23-1c10.pdf","current_through":"2026-07-31T11:12:02","vintage":"","retrieved_at":"2026-09-02T21:04:14Z","sha256":"815f4a8035b37c6a8c137b27c9de277df1912118c653e1e766d3fd63728aadee","source_id":"us-nd","stale":true,"prev":"us-nd/n.d.-cent.-code-23.1-10-04","next":"us-nd/n.d.-cent.-code-23.1-10-06"},"notice":"GroundRules: Original legal text.
