Code § 25-16-03","heading":"Requirements for license","body":"The department shall issue a license for the operation of an agency providing services to individuals with a developmental disability upon a showing that:\n1.The premises to be used are safe, sanitary, and properly equipped to provide good care;\n2.The persons in charge of the provider agency, including their assistants, are qualified by training and experience to carry on efficiently the duties required of them;\n3.The health, safety, and well-being of individuals receiving services are protected;\n4.A variety of meaningful activities, treatment, educational opportunities, and physical facilities are available;\n5.Appropriate arrangements are made for a medical and psychological examination of each individual; and\n6.The provider is in compliance with rules adopted by the department under this chapter.","path":["Title 25 Mental And Physical Illness Or Disability","Chapter 25-16 Residential Care And Services For The Developmentally Disabled"],"source_url":"https://ndlegis.gov/cencode/t25c16.pdf","current_through":"2026-07-31T11:12:02","vintage":"","retrieved_at":"2026-09-02T21:04:14Z","sha256":"9c000861a1bbc5b59b168cff921b53f60f76a16377bef9788ed571d9b6d67134","source_id":"us-nd","stale":true,"prev":"us-nd/n.d.-cent.-code-25-16-02","next":"us-nd/n.d.-cent.-code-25-16-03.1"},"notice":"GroundRules: Original legal text.
