Code § 26.1-46-06","heading":"Purchasing groups - Exemption from certain laws relating to the group purchase of insurance","body":"A purchasing group and its insurer or insurers is subject to all applicable laws of this state, except that a purchasing group and its insurer or insurers are exempt, in regard to liability insurance for the purchasing group, from any law that would:\n1.Prohibit the establishment of a purchasing group.\n2.Make it unlawful for an insurer to provide or offer to provide insurance on a basis providing, to a purchasing group or its members, advantages based on their loss and expense experience not afforded to other persons with respect to rates, policy forms, coverages, or other matters.\n3.Prohibit a purchasing group or its members from purchasing insurance on a group basis described in subsection 2.\n4.Prohibit a purchasing group from obtaining insurance on a group basis because the group has not been in existence for a minimum period of time or because any member has not belonged to the group for a minimum period of time.\n5.Require that a purchasing group must have a minimum number of members, common ownership or affiliation, or certain legal form.\n6.Require that a certain percentage of a purchasing group must obtain insurance on a group basis.\n7.Otherwise discriminate against a purchasing group or any of its members.\n8.Require that any insurance policy issued to a purchasing group or any of its members be countersigned by an insurance producer residing in this state.","path":["Title 26.1 Insurance","Chapter 26.1-46 Risk Retention Groups And Purchasing Groups"],"source_url":"https://ndlegis.gov/cencode/t26-1c46.pdf","current_through":"2026-07-31T11:12:02","vintage":"","retrieved_at":"2026-09-02T21:04:14Z","sha256":"12f618164c4eff3efd6792940cce95e720de25df1d9ed8c3974ec98d6b61e2c9","source_id":"us-nd","stale":true,"prev":"us-nd/n.d.-cent.-code-26.1-46-05","next":"us-nd/n.d.-cent.-code-26.1-46-07"},"notice":"GroundRules: Original legal text.
