Code § 29-22-38","heading":"Juror counseling following graphic evidence or testimony","body":"1.The court shall offer, not more than ten hours of post-trial psychological counseling, without charge, to a juror or alternate juror who served on a trial jury in a trial involving extraordinarily graphic, gruesome, or emotional evidence or testimony.\n2.The counseling offered under subsection 1 applies only to a juror or alternate juror who served on a trial jury for a trial involving the following offenses:\na.Murder under section 12.1-16-01;\nb.Manslaughter under section 12.1-16-02;\nc.Negligent homicide under section 12.1-16-03;\nd.Felony-level assault or domestic violence under chapter 12.1-17;\ne.A sexual offense under chapter 12.1-20 or 12.1-27.2;\nf.Abuse or neglect of a child under sections 14-09-22 and 14-09-22.1; and\ng.Others as determined by the court.\n3.The counseling offered under this section:\na.Must occur not later than one hundred eighty days after the jury is discharged;\nb.May be provided by the court system, by a state agency, or by contract; and\nc.May be individual or group counseling.","path":["Title 29 Judicial Procedure, Criminal","Chapter 29-22 Jury After Submission Of Cause And Verdict"],"source_url":"https://ndlegis.gov/cencode/t29c22.pdf","current_through":"2026-07-31T11:12:02","vintage":"","retrieved_at":"2026-09-02T21:04:14Z","sha256":"305a6184321a53b483a753a3414bd55b37fd731085fbc9c175e3b25273bbade3","source_id":"us-nd","stale":true,"prev":"us-nd/n.d.-cent.-code-29-22-37","next":"us-nd/n.d.-cent.-code-29-23-01"},"notice":"GroundRules: Original legal text.
