Code § 29-30.3-05","heading":"(2-102) Issuance of process or arrest warrant prior to receipt of demand or request","body":"1.A magistrate for the county where arrest is sought shall authorize the issuance of an arrest warrant or other process to obtain the appearance of a person, if testimony or affidavit shows probable cause to believe:\na.The person is in this state; and\nb.The person is the subject of another state's arrest warrant issued for:\n(1)The commission of a crime punishable by death or imprisonment for a term exceeding one year;\n(2)Escape from confinement; or\n(3)Violation of any term of bail, probation, parole, or order arising out of a criminal proceeding.\n2.Other process to obtain the appearance of a person must require the appearance before a magistrate.\n3.The arrest warrant must require that the person be brought forthwith before a magistrate.","path":["Title 29 Judicial Procedure, Criminal","Chapter 29-30.3 Uniform Extradition And Rendition Act"],"source_url":"https://ndlegis.gov/cencode/t29c30-3.pdf","current_through":"2026-07-31T11:12:02","vintage":"","retrieved_at":"2026-09-02T21:04:14Z","sha256":"a956969ee252669aad6e615517175b6274564295913f8ea0be3f44e4b249f38c","source_id":"us-nd","stale":true,"prev":"us-nd/n.d.-cent.-code-29-30.3-04","next":"us-nd/n.d.-cent.-code-29-30.3-06"},"notice":"GroundRules: Original legal text.
