Code § 31-03-25","heading":"Summoning witness in this state to testify in another state","body":"If a judge of a court of record in any state which by its laws has made provision for commanding persons within that state to attend and testify in a criminal prosecution in this state, certifies under the seal of such court that:\n1.There is a criminal prosecution pending in such court;\n2.A person who is within this state is a material witness in such prosecution; and\n3.The person's presence will be required for a specified number of days, any judge of a court of record in the county in which such person may be, upon presentation of such certificate, shall fix a time and place for a hearing and shall notify the witness of such time and place.","path":["Title 31 Judicial Proof","Chapter 31-03 Means Of Compelling Attendance Of Witnesses"],"source_url":"https://ndlegis.gov/cencode/t31c03.pdf","current_through":"2026-07-31T11:12:02","vintage":"","retrieved_at":"2026-09-02T21:04:14Z","sha256":"aedb1a3d56e96cf34c6b249c50b086f26811c94c1196fa4f77d05170d82c9ba3","source_id":"us-nd","stale":true,"prev":"us-nd/n.d.-cent.-code-31-03-24","next":"us-nd/n.d.-cent.-code-31-03-26"},"notice":"GroundRules: Original legal text.
