Code § 32-10.1-06","heading":"Disqualification from appointment as receiver - Disclosure of interest","body":"1.The court may not appoint a person as receiver unless the person submits a statement to the court under penalty of perjury that the person is not disqualified.\n2.Except as provided under subsection 3, a person is disqualified from appointment as receiver if the person:\na.Is an affiliate of a party;\nb.Has an interest materially adverse to an interest of a party;\nc.Has a material financial interest in the outcome of the action, other than compensation the court may allow the receiver;\nd.Has a debtor-creditor relationship with a party; or\ne.Holds an equity interest in a party, other than a noncontrolling interest in a publicly traded company.\n3.A person is not disqualified from appointment as receiver because the person:\na.Was appointed receiver or is owed compensation in an unrelated matter involving a party or was engaged by a party in a matter unrelated to the receivership;\nb.Is an individual obligated to a party on a debt that is not in default and was incurred primarily for personal, family, or household purposes; or\nc.Maintains with a party a deposit account as defined under section 41-09-02.\n4.A person seeking appointment of a receiver may nominate a person to serve as receiver, but the court is not bound by the nomination.","path":["Title 32 Judicial Remedies","Chapter 32-10.1 Uniform Commercial Real Estate Receivership Act"],"source_url":"https://ndlegis.gov/cencode/t32c10-1.pdf","current_through":"2026-07-31T11:12:02","vintage":"","retrieved_at":"2026-09-02T21:04:14Z","sha256":"6add1c409392a033b7e34ec3478ec73f91999c6989d4c048b7b8ec7c0613ceee","source_id":"us-nd","stale":false,"prev":"us-nd/n.d.-cent.-code-32-10.1-05","next":"us-nd/n.d.-cent.-code-32-10.1-07"},"notice":"GroundRules: Original legal text.
