Code § 32-21-03","heading":"Who may bring action","body":"The action shall be brought by the following persons in the order named:\n1.The surviving husband or wife, if any.\n2.The surviving children, if any.\n3.The surviving mother or father.\n4.A surviving grandparent.\n5.The personal representative.\n6.A person who has had primary physical custody of the decedent before the wrongful act.
