Code § 32-49-03","heading":"Exceptions to liability","body":"1.As used in this section:\na.\"Child\" means an unemancipated individual who is less than eighteen years of age.\nb.\"Parent\" means an individual recognized as a parent under a law of this state other than this chapter.\n2.A person is not liable under this chapter if the person proves that disclosure of, or a threat to disclose, an intimate image was:\na.Made in good faith:\n(1)By law enforcement;\n(2)In a legal proceeding; or\n(3)For medical education or treatment;\nb.Made in good faith in the reporting or investigation of:\n(1)Unlawful conduct; or\n(2)Unsolicited and unwelcome conduct;\nc.Related to a matter of public concern or public interest; or\nd.Reasonably intended to assist the depicted individual.\n3.Subject to subsection 4, a defendant who is a parent or legal guardian of a child is not liable under this chapter for a disclosure or threatened disclosure of an intimate image of the child.\n4.If a defendant asserts an exception to liability under subsection 3, the exception does not apply if the plaintiff proves the disclosure was:\na.Prohibited by law other than this chapter; or\nb.Made for the purpose of sexual arousal, sexual gratification, humiliation, degradation, or monetary or commercial gain.","path":["Title 32 Judicial Remedies","Chapter 32-49 Uniform Civil Remedies For Unauthorized Disclosure Of Intimate Images"],"source_url":"https://ndlegis.gov/cencode/t32c49.pdf","current_through":"2026-07-31T11:12:02","vintage":"","retrieved_at":"2026-09-02T21:04:14Z","sha256":"51fa6ca6031be62948f7209d1f7a5bb605627bd64b48f0cac5789ceafc24aa59","source_id":"us-nd","stale":true,"prev":"us-nd/n.d.-cent.-code-32-49-02","next":"us-nd/n.d.-cent.-code-32-49-04"},"notice":"GroundRules: Original legal text.
